Neutral Citation No. - 2025:AHC-LKO:27085-DB Court No. - 2 Case :- WRIT - C No. - 4142 of 2025 Petitioner :- M/S Red Onion Thru. Proprietor Mr. Mikesh Kumar Dikshit Respondent :- State Of U.P. Thru. Prin. Secy. Social Welfare Deptt. Lko. And 4 Others Counsel for Petitioner :- Sanjay Awasthi Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J. Heard. We have perused our order dated 18.04.2025 passed in Writ C No. 23779 of 2021 which reads as under:- "The Officer has joined the proceedings through video conferencing. Learned Additional C.S.C. for the State has filed affidavits on behalf of the opposite party No.2 & 5, which are taken on record. The payment, due to the petitioner, has been made as accepted by the petitioner's Counsel. If the petitioner claims any interest or penal interest on the due amount, he can maintain separate proceedings in this regard. The amendment application bearing C.M. Application No.IA/6/2023 is disposed of. The writ petition stands disposed of." No doubt, we had granted liberty to the petitioner to claim interest or penal interest on the due amount by separate proceedings, but we did not mean that a writ petition would be maintainable for such purpose. The petitioner may raise a claim, as per law and seek such other remedies, as may be prescribed. The writ petition is accordingly disposed of.
