Heard learned counsel for the petitioner and learned standing counsel for the State-respondent. This petition has been filed by the petitioner praying for issuance of a writ of Certiorari quashing the impugned selection list issued by respondent No.5-District Programme Officer so far as it relates to respondent No.7 on the post of Anganwadi Worker. Learned standing counsel, on the basis of written instructions which are taken on record, has submitted that petitioner is a candidate of APL category and, therefore, on the basis of academic merit prepared by the department she comes at second place in the select list. The selected candidate Arti Yadav who is a BPL category candidate has secured first place after acquiring highest merit i.e. 12.066 and thus, given priority in the selection on the post of Anganwadi Worker. In view of these instructions as also considering the policy laid down in the Government Order dated 21.03.2023 and the fact that selection in question on the post of Anganwadi Worker has been done strictly on the basis of merit and priority to BPL category candidate has been given in terms of the Government Order dated 21.03.2023, there appears to be no illegality in the impugned selection.
