Neutral Citation No. - 2025:AHC-LKO:24748 Court No. - 18 Case :- WRIT - A No. - 4623 of 2025 Petitioner :- Lucky Pandey (Pno - 112322377) Respondent :- State Of U.P. Thru. Addl. Chief Secy. Home Lko. And 3 Others Counsel for Petitioner :- Vyomesh Chandra Shukla,Abhishek Singh Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned Standing counsel for the respondents. The petition has been filed with the following prayers:-
"i) Issue a writ, order or direction in the nature of Mandamus commanding/directing the opposite parties to sympathetically consider the case of the petitioner who is working on the post of Lady Head Constable in Reserve Police Line, Gorakhpur to transfer her from District Gorakhpur to District Azamgarh in light of Clause 5(iii) of the Transfer Policy dated 11.06.2024 (as contained in ANNEXURE NO. 01 to this writ petition). ii) Issue a writ, order or direction in the nature of Mandamus commanding/directing the opposite parties to sympathetically consider and decide the representation of the petitioner dated 03.04.2025 for her transfer from District Gorakhpur to District Azamgarh (as contained in ANNEXURE NO. 03 to this writ petition)"
Learned counsel for the petitioner submits that the petitioner has been serving in District Gorakhpur for the past 13 years. She is the mother of two minor children and is experiencing hardship as her husband is employed in District Azamgarh. It is further submitted that if the petitioner is transferred to District Azamgarh, she would be better able to balance her official responsibilities and take care of her children. At present, due to the absence of fixed duty hours, she is compelled to leave her
minor children at a creche, which makes it extremely difficult to manage both personal and professional obligations. Hence, in light of Clause 5(3) of the Transfer Policy dated 14.06.2024, it is requested that her case be considered sympathetically. Learned Standing Counsel has no objection, if the respondents are directed to take a decision on the petitioner’s representation. Accordingly, without entering into the merits of the case, the writ petition is disposed of with liberty to the petitioner to submit a fresh representation before respondent no. 3 within two weeks from today. Respondent no. 3 is directed to consider and decide the representation within a further period of four weeks by passing a reasoned and speaking order.
