This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:-
“…to declare the action of the respondents in not issuing family pension to petitioner which is totally illegal, arbitrary and violative of Article 14 of the Constitution of India and consequently to Direct the 5th respondent to grant family pension to the petitioner by implement the Municipal Administration Department Adoni, Commissioner recommendation letter 7th respondent dated 17-09-2024 regarding to sanction family pension to petitioner as per G.O.Ms.No.315, dated 07-10-2010 and G.O.Ms.No.353 dated 04-12-2010 and pass.…”

2. Heard Sri Ch.S.V.Suraj, learned counsel for the petitioner and learned Government Pleader for Services-I for respondent Nos.1 to 5 and Sri Gudapati Laxminarayana, learned Standing Counsel for Municipalities for respondent Nos.6 and 7.

The petitioner claiming to be dependant applied for the family pension on 31.12.2016 by submitting all relevant documents, as she survived by her mother, who retired as Public Health Worker (PHW) in 7th respondent / Municipality and died on 06.11.2007. The 7th respondent vide proceedings dated 17.09.2024 addressed to the 5th respondent recommended the case of the petitioner for release of family pension, which is stated to be pending. The petitioner also submitted a representation dated 21.10.2024 to the 3rd respondent and the same is also pending for consideration.

Learned counsel for the petitioner submits that it would suffice to direct the respondents to consider and pass appropriate orders of the aforesaid representation, considering the recommendation made by the 7th respondent to the 5th respondent.
5. Learned Assistant Government Pleader appearing for the respondents submit that the petitioner’s case will be considered in accordance with law, if she is otherwise entitled for the family pension.

In view of the above said circumstances, and in view of the fact that the 7th respondent has already made recommendation for release of family pension by proceedings dated 17.09.2024 as addressed to the 5th respondent, the writ petition is disposed of with the consent of both counsel appearing and without expressing any opinion on the merits of the case. The respondent Nos.3 and 5 are
directed to consider and pass appropriate orders on petitioner’s representation dated 21.10.2024 for release of family pension in accordance with law, within a period of six (06) weeks, from the date of receipt of copy of this order.
7. Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
