Order on C.M. Application No. 1 of 2025 1.Vakalatnama filed by Sri Anil Kumar Upadhyay, learned counsel on behalf of opposite parties is taken on record.
2. There is reported delay of 60 days in filing the instant special appeal.
3. Reasons spelt out for the cause of delay being sufficient and in absence of any objection, the application for condonation of delay is allowed and delay is condoned.
Order on Appeal
4. Heard learned counsel for the parties.
5. The intra-court appeal instituted by the State of U.P is
directed against the judgement/order rendered by writ court in Writ- A No.12716 of 2024 on 23.01.2025 whereby the claim of revised pension having regard to the Career Progression Scheme was allowed by this Court by dealing with the relevant aspects of the matter.
6. The writ court while allowing the claim for grant of revision of pension has clearly observed that once the time scale on completion of 24 years of satisfactory service was allowed under the Assured Career Progression (ACP) Scheme, there is no reason as to why the consequential benefit of revised pension may not be granted to the respondents.
7. The reason spelt out by the writ court in the impugned
order does not call for any interference by this Court under Chapter VIII Rule 5 of the Allahabad High Court Rules, 1952.
8. The intra-court appeal being bereft of any merit is accordingly dismissed. (Om Prakash Shukla,J. ) (Attau Rahman Masoodi,J.)
