JUSTICE DEVASHIS BARUAH O R D E R 19.09.2025 Heard Mr. B. K. Das, the learned counsel appearing on behalf of the petitioner. Mr. I. Choudhury, the learned Senior Counsel assisted by Mr. B. Sharma, the learned counsel appears on behalf of respondent Nos.1 & 2. 2. This Court vide an order dated 18.09.2025 enquired with the learned Senior Counsel appearing on behalf of the respondent Nos.1 & 2 whether in the present case, the petitioner can be given a further opportunity by taking his financial documents subject to the petitioner being eligible in respect to all other parameters of the tender documents, and accordingly, had fixed the instant proceeding for today. 3. Mr. I. Choudhury, the learned Senior Counsel has produced an email dated 19.09.2025 issued by the DGM-Contracts on behalf of the CGM-Contracts (HoD) of the respondent No.1 wherein the respondent Nos.1 & 2 are willing to provide a further opportunity to the petitioner by taking his financial documents Page No.# 3/3 subject to the petitioner being eligible in respect to all other parameters of the tender documents. The said email is kept on record and marked with the letter “X”. 4. Mr. B. K. Das, the learned counsel for the petitioner submits that the petitioner in view of the stand being taken by the respondent Nos.1 & 2 does not have any further grievance. 5. Taking into account the above, the instant writ petition, therefore, stands closed directing the Respondent Authorities, more particularly the respondent Nos.1 & 2 to accept the financial documents of the petitioner which were submitted by the petitioner on 20.02.2025 and the respondents shall duly consider the bid of the petitioner keeping in mind that the petitioner is otherwise eligible in respect to all other parameters of the tender document.
