Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State of Assam. This application has been filed under Section 483 of the BNSS, 2023 in respect of Lakhipur P.S. Case No.56/2025 registered under Section 22 (b) of NDPS Act. Page No.# 2/2 The case diary has not been received. The petitioner has already spent 54 days in judicial custody. I have considered the submissions made by the learned counsel for both sides. This Court is of the opinion that in this case the period of detention already undergone by the petitioner in custody should be taken up as a ground for releasing him on bail. Accordingly, considering the period of detention undergone by the petitioner in custody, the bail application is allowed. The petitioner Ashraful Alom, who was arrested in connection with Lakhipur P.S. Case No.56/2025 shall be released on bail of Rs.25,000/- with surety of like amount to the satisfaction of the learned Special Judge, Goalpara. With the above observation, the bail application stands disposed of. JUDGE Comparing Assistant
