Neutral Citation No. - 2025:AHC-LKO:24351 Court No. - 18 Case :- WRIT - A No. - 4630 of 2025 Petitioner :- Arun Kumar Respondent :- U.O.I Thru. Ministry Of Personnel, Public Grievance And Pension, Thru. Secy. And Another Counsel for Petitioner :- Ratnesh Chandra,Manav Rathore Counsel for Respondent :- A.S.G.I.,C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard Shri Ratenesh Chandra, learned counsel for the petitioner, Shri Sudarshan Sohan, learned counsel for respondent no. 1, and the learned Standing Counsel appearing for respondent no. 2. At the outset, Shri Sudarshan Sohan, learned counsel for respondent no. 1 has raised a preliminary objection regarding the maintainability of the petition, in view of the availability of a statutory alternative remedy under Section 14 of the Central Administrative Tribunal Act. In support of this objection, he has placed reliance on the Constitution Bench judgment of the Hon’ble Supreme Court in L. Chandra Kumar v. Union of India and Others, (1997) 3 SCC 261. Emphasis is on para 99 of the judgment. Perused the record, so also the judgment of the Constitution Bench of the Supreme Court. The legal position on this issue is well settled. The petitioner has an efficacious alternative remedy in the form of filing an Original Application before the Central Administrative Tribunal for redressal of his grievance. The petition is not maintainable and is accordingly dismissed. Order Date :- 29.4.2025 R.C. Digitally signed by :- RAM CHANDER YADAV High Court of Judicature at Allahabad, Lucknow Bench
