[2025:RJ-JP:26438] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous 4th Bail Application No. 4655/2025 Deepak Yadav @ Deepu @ Deepak Rajpura S/o Shri Sukampal, Aged About 22 Years, R/o Village Rajpura Police Station Ateli Mandi, Tehsil Ateli, District Mahendragarh (Haryana) (At Present Confined In Central Jail Jaipur) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Kuldeep Yadav For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 16/07/2025 1. The instant fourth bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No.195/2024 registered at Police Station Harmada, District Jaipur (West) for the offence(s) under Sections 302 and 115 of IPC and Sections 3/25 and 5/25 of Arms Act. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the main allegations are against Akash Kumar, Urvesh Meena & Kush Agarwal and the petitioner has remained in custody since 14.03.2024. It is further contended that the other co-accused apart from Akash Kumar, Urvesh Meena & Kush Agarwal have already been enlarged on bail, there are no [2025:RJ-JP:26438] (2 of 3) [CRLMB-4655/2025] criminal antecedents against the present accused petitioner. It is also contended that the third bail application filed by the accused- petitioner was for grant of interim bail and the first bail application of the accused-petitioner was dismissed as withdrawn and subsequently the second bail application was dismissed by this Court after filing of the charge-sheet. It is also contended that the charge-sheet was filed on 07.06.2024 and the prosecution has adduced list of 41 witnesses to be examined and the Trial Court has not yet examined even a single witness. Therefore, the fourth bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the fourth bail application and contended that the petitioner's second bail application was decided on merits, thereafter, there is no change in circumstance in the present case and the recovery of fire arm was made from the possession of petitioner, therefore, considering the facts of the case, the fourth bail application of the accused-petitioner deserves dismissed. 4. Heard and perused the material available on record. 5. Considering the long incarceration of the accused-petitioner and also that there are no criminal antecedents against the accused-petitioner, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the fourth bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Deepak Yadav @ Deepu @ Deepak Rajpura S/o Shri Sukampal, in connection with FIR No.195/2024 registered at Police Station Harmada, District Jaipur (West) shall be enlarged on [2025:RJ-JP:26438] (3 of 3) [CRLMB-4655/2025] bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
