By this petition, petitioner herein has challenged impugned Fresh E-NIT No. 05 JCRE of 2025-26, dated 13.11.2025, issued by the respondent No. 3, which, as per the petitioner, has been issued in violation of the terms and conditions of Request for Proposal (REP), “Engagement of concessionaire to manage advertisement of Static Ad-panels installed by WP (C) No. 3453/2025 H I G H C O U R T O F J A M M U & K A S H M I R A N D L A D A K H Jammu Smart City Limited,” vide e-NIT No. JSCL 171/01 of 2024-25, dated 30.01.2025, with a further direction upon the respondents to recognize the petitioner’s Right of First Refusal (RoFR), under Clause 33.4 of Request for Proposal (REP), dated 30.01.2025. 2. Learned counsel for respondent No. 2, who was directed to seek instructions, states at Bar, that no response has been received, in terms of E-NIT No. 05 JCRE of 2025-26, dated 30.01.2025, as such, JMC, respondent No. 2, is going to float fresh tender thereby cancelling e-NIT dated 13.11.2025. The copy of communication dated 08.12.2025, in this behalf addressed by the counsel, is taken on record. 3. Since the impugned e-NIT stands cancelled, therefore, nothing remains for adjudication. 4.
