Neutral Citation No. - 2025:AHC-LKO:1544 Court No. - 7 Case :- MATTERS UNDER ARTICLE 227 No. - 4272 of 2020 Petitioner :- Sant Ram Respondent :- Addl.District Judge/F.T.C.-Ii Ambedkar Nagar And Ors. Counsel for Petitioner :- Bal Gangadhar Tripathi,Aatreya Tripathi Counsel for Respondent :- Rajesh Kumar,Shivam Pandey Hon'ble Pankaj Bhatia,J. Heard learned counsel for the petitioner and Shri Rajesh Kumar, learned counsel for the respondents. The present petition has been filed challenging the order dated 06.12.2019 passed by the appellate authority whereby the amendment application filed by the plaintiff was allowed. While dealing with the objections raised by the petitioner, the respondent in the appeal, it was recorded that the petitioner has opposed the said amendment application on the ground that his right would be affected and the application was filed with delay. Both the said contentions were rejected and it was further recorded that proposed amendment would not change the nature of suit. The amendment application on record also indicate that the amendment was clarificatory and explanatory in nature. I do not see any reason to interfere with the appellate order. The petition is dismissed. Order Date :- 8.1.2025 J. K. Dinkar Digitally signed by :- JESHU KUMAR DINKAR High Court of Judicature at Allahabad, Lucknow Bench
