Uddin, learned counsel for the petitioners. Also heard Shri J. Handique, learned Govt. Advocate whereas Shri J. Abedin, learned counsel has appeared for the respondent no. 5. Though Shri A. I. Uddin, learned counsel for the petitioners has submitted that the issue was already decided in an earlier round of litigation, this Court has noticed that there would be a question of locus to maintain the present petition, as the petitioners before this Court were not the candidates in the election for the ward in question. At this stage, the learned counsel for the petitioners submits that he may be allowed to withdraw this petition with a liberty to approach through the proper person. Page No.# 3/3 The aforesaid prayer is not objected to by the learned counsel for the respondents. Writ petition is accordingly dismissed on withdrawal with liberty, as prayed for.
