The Writ of Mandamus has been instituted to direct the 3rd respondent to initiate disciplinary action under Bar Council Rules against the 5th respondent R.Anand, Advocate, who falsely represented as counsel on record in W.P. 2/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.15157 of 2025 (MD)No.2284 of 2025 for the respondents 5 to 7 on 17.02.2025 in Court Hall No. 18 in Item No.91 in this Court on the petitioner's petition dated 28.02.2025 and the petitioner's counsel petition dated 27.02.2025. 2.The petitioner has raised several allegations against the 5th respondent, who is the practicing Advocate. It is contended that the Bar Council has not initiated any action, which resulted in institution of the present Writ proceedings. 3.The learned Senior Counsel appearing for the 5th respondent would submit that the allegations are false. Thus, this Writ Petition is to be rejected in limini. 4.This Court is of the considered opinion that at this stage this Court cannot conduct a roving enquiry in respect of the allegations raised by the petitioner against the 5th respondent. However, the Bar Council on receipt of any complaint is duty bound to look into the nature of the complaint and take a decision to proceed or not to proceed on the complaint. 3/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.15157 of 2025 5.The learned counsel appearing for the Bar Council / 3rd respondent would submit that the complaint filed by the petitioner will be looked into. 6.In view of the above, the Bar Council may look into the complaint and conduct enquiry, if requires and take appropriate decision on merits and in accordance with law and by affording opportunity of hearing to all the parties concerned, within a period of four (4) weeks from the date of receipt of a copy of this order. The petitioner is at liberty to give a complaint along with documents, evidences etc., if any available. 7.With the above observations, this Writ Petition stands disposed of. No costs.
