Ashwani Kumar Sharma vs. C.K. Mathew and others CMP No.10889 of 2019 in COPC No.4329 of 2013 21.03.2025 Present: Mr. Ajay Sharma, Senior Advocate with Mr.Atharv Sharma, Advocate for the petitioner. Mr. R.K. Gautam, Senior Advocate with Mr.Jai Ram Sharma, Advocate for the respondents. It is heartening to note that the orders passed by this Court have finally been complied with, as is evident from the allotment order dated 19.03.2025 placed by the learned counsel for the respondents before this Court. However, in the order of allotment, it is stated that the possession of the land so allotted has not yet been handed over to the petitioner. Let the same be handed over to the petitioner within the time period stipulated in the allotment order, subject to the petitioner complying with the terms of such allotment order. It is clarified that at the time of handing over of possession and Khatedari to the petitioner, the Chief Secretary, Rajasthan shall ensure that there is no unnecessary law and order problem by any person(s). At the same time, the Superintendent of Police, District Anupgarh shall also ensure that adequate police protection is given to the petitioner at the time of handing over the possession of the land and ‘Khatedari’ in question. Lastly, it is made clear that in case there is a failure to comply with the order passed by this Court, the same shall be viewed very seriously and shall result in automatic revival of the contempt petition. Application stands disposed. ( Tarlok Singh Chauhan ) Judge March 21, 2025 (naveen)
