The present petition has been filed with the following prayer : "Issue a writ, order or direction in the nature of MANDAMUS thereby commanding the opp. Parties specially the opp. Party No. 2 to 4 to remove the illegal encroachment of the Opp. party No. 8 to 10 from the land gata No 520 area 0.2150 hec. situated at village Katuri Khurd, Tehsil Fatehpur, District Barabanki which is recorded as Marghat in the revenue record with immediate effect, but the opp. party No.5 to 7 instead of removing the illegal encroachment providing shelter to them." 3. Standing Counsel based upon the instructions states that even the petitioner has encroached the part of the property. 4. In view of the said statement, the present petition is disposed off permitting the respondents to initiate the proceedings against the encroachers and conclude the action in accordance with law within the time as prescribed under the statute.
