Heard learned Counsel for the petitioner and the Standing Counsel. 2. The present petition has been filed with the following prayer : (I) Issue a writ, order, or direction in the nature of Mandamus commanding and directing the respondent authorities, especially Opposite Party No. 2 (District Magistrate, Hardoi), to conduct an immediate investigation into the misappropriation of public funds and unauthorized removal of public assets by Opposite Party No. 5 (Gram Pradhan) in Village Shahpur Nau, Tehsil Shahabad, District Hardoi, and to take appropriate legal action. (II). Issue a writ, order, or direction in the nature of Mandamus directing the respondent authorities to restore the misappropriated public assets, including handpumps, water tanks, and motors, to their original locations in Village Shahpur Nau. 3. Considering the fact that the petitioner has an efficacious remedy by filing an appropriate application under Rule 3 of U.P. Panchayat Raj (Removal of Pradhan, Up-Pradhan and Members) Enquiry Rules, 1997, the present petition is disposed off permitting the petitioner to file a proper application under Rule 3 of the Rules. In case such an application is filed, the same shall be decided in accordance with law by the concerned authority. 4. The writ petition stands disposed off with the said observations.
