(Section 372 of the Cr.P.C.) against the Judgment and Order dated 05.04.2025 passed by learned Additional District Judge-12/Special Judge, POCSO Act, Sultanpur, in Sessions Trial No. 688 of 2022: State Vs. Mahaveer Chauhan, arising out of Case Crime No. 158 of 2021, under sections 376, 363, 366 of the I.P.C. & Section ¾ of the POCSO Act,2012, Police Station- Bandhuakala, District-Sultanpur. We have noticed that at the time of the alleged incident in the year 2021, the victim was 16 years old, however, she has attained the age of majority, but, her father has come before this court by filing the appeal. Learned counsel for the appellant prays that he may be permitted to withdraw the instant appeal with liberty to file a fresh criminal appeal. In view of the aforesaid submission of learned counsel for the appellant, the instant criminal appeal is dismissed as withdrawn with the aforesaid liberty.
