ORDER:
1. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioners submits that the petitioners are aggrieved by the docket order, dated 25.06.2024, passed in Crl.M.P.No. 253 of 2023 in D.V.C. No. 19 of 2015 on the file of the Court of the Special Judicial Magistrate of First Class for Trial of Excise Cases, Nellore, whereby non-bailable warrants were issued against the petitioners for non-appearance.
3. The learned counsel further submits that the 1st petitioner is liable to pay an amount of Rs.9,60,000/- towards arrears of maintenance. It is submitted that the 1st petitioner is willing to pay the amount. However, the issuance of warrants without effecting due service of summons or publication is causing severe hardship to the 1st petitioner and his aged mother, the 2nd petitioner.
4. Considering the same, there shall be a stay of operation of the docket
order, dated 25.06.2024, subject to the condition that the petitioners’ deposit 50% of the arrears of maintenance. The petitioners shall draw a demand draft for 50% of the arrears in favour of the 2nd respondent and deposit the same before the Special Judicial Magistrate of First Class for Trial of Excise Cases, Nellore. Upon such deposit, the demand draft

shall be handed over to the 2nd respondent under proper acknowledgment. The petitioners shall file a petition for the recall of the non-bailable warrants, which shall be considered upon compliance with the conditions imposed by this court. Accordingly, the criminal petition is
disposed of.
5. The petitioners shall deposit the 50% of the arrears as directed within four (4) weeks from the date of this order. Till such time, the execution of the warrants against the petitioners shall not be executed.
6. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed. ____________________ JUSTICE HARINATH.N Dt.03.04.2025 BV
