Neutral Citation No. - 2025:AHC-LKO:24845-DB Court No. - 2 Case :- WRIT - C No. - 3992 of 2025 Petitioner :- Deep Mala Respondent :- U.O.I. Thru. Secy. Ministry Of Petroleum And Natural Gas New Delhi And Others Counsel for Petitioner :- Bipin Kumar Rai Counsel for Respondent :- A.S.G.I.,Shikhar Anand Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J.
1. Heard.
2. The petitioner had earlier approached this Court, challenging the communication dated 01.03.2024, by which the petitioner's candidature for allotment of retail outlet had been rejected by the opposite parties no. 2 and 3-Company provisionally, granting time to him to submit a representation in this regard. Court ordered disposal of the petitioner’s representation, which has been done vide communication dated 07.10.2024, wherein it has been stated that the land offered by the petitioner does not fall in village Behtamujawar but it falls in village Ramkot and in support thereof, an order of the Sub-Divisional Magistrate is mentioned copy of which is annexed at page 65 of the writ petition.
3. The contention of the petitioner's Counsel is that Behtamujawar is a Gaon Sabha, which comprises two villages, Behtamujawar and Ramkot. However, we are not impressed with this argument, as, it is not the Gaon Sabha, which is
relevant but the village for which the retail outlet has been advertised, a copy of which is annexed as Annexure No. 2 to the petition. It is not a fit case for interference.
4. The writ petition is dismissed. . (Om Prakash Shukla, J.) (Rajan Roy, J.) Order Date :- 30.4.2025 Ajit Digitally signed by :- AJIT KUMAR High Court of Judicature at Allahabad, Lucknow Bench
