GP FOR SERVICES I 2 W.P.No.8536 of 2025 The Court made the following order: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…to issue a writ, order or direction more in the nature of WRIT OF MANDAMUS declaring the impugned Proc.CR.No.12027/ 14/2023/CPE/B4, dated 13-3-2024 and the final seniority list of Prohibition and Excise Inspectors of Zone III and Integrating seniority list of Multi Zone II for the panel years from 2008-09 to 2017-18 vide Cr.No.12027/14/2023/CPE/B4, dated 14-3-2024 issued by the 2nd respondent in so far as placing the petitioner at SI.No.55 instead of at SI.No.48 in Zonal Seniority list of Zone III and at SI.No.162 instead of SI.No.99 of Multi Zone-ll is as illegal, arbitrary, unjust, contrary to G.O.Rt.No.102, dated 19-1- 2013 and also contrary to the provisions of Presidential Order and violative of Articles 14, 16 and 21 of the Constitution and consequently set aside the same in so far placement of the petitioner is concerned and hold that the name of the petitioner is required to be included at SI.No.48 in Zonal seniority list of Zone III and at SI.No.99 in Multi Zonal seniority list of Multi Zone-ll below Sri R.Vijaya Bhaskar in terms of G.O.Rt.No.102, dated 19-1-2013 in Zone III with all consequential benefits including promotion on that basis, and pass such other order or orders.…” 2. Heard Sri P.Narasimha, learned counsel for the petitioner and learned Assistant Government Pleader for Services-I for respondents. 3. After arguing for sometime, when it was pointed out by learned Assistant Government Pleader for Services-I that against the final seniority list, where Gazetted on 14.03.2024 (Ex.P2), there is an alternative remedy of appeal before the Government, learned counsel for the petitioner seeks liberty to avail alternative remedy by filing appeal. 3 W.P.No.8536 of 2025 4. Since there is an effective alternative remedy, the petitioner is granted liberty to approach the Government by preferring appeal. 5. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
