Although the writ Court, vide judgment and order dated 22.03.2021, a copy of which is annexure 5 to the petition, had directed the appellate authority to decide the statutory department appeal filed by petitioner yet by means of the order impugned dated 18.02.2022, a copy of which is annexure 1 to the petition, the appeal has been rejected on the ground of delay. 3. Considering the aforesaid, the order impugned dated 18.02.2022, a copy of which is annexure 1 to the petition, is set aside. The appellate authority is directed to decide the appeal of the petitioner, keeping in view of the judgment of this Court dated 22.03.2021, on merits.
