Neutral Citation No. - 2025:AHC-LKO:4138 Court No. - 18 Case :- CONTEMPT APPLICATION (CIVIL) No. - 1800 of 2024 Applicant :- Ritesh Mehrotra And Another Opposite Party :- Sri Amrit Abhijat, Prin. Secy. Deptt. Of Urban Development Lko. And Others Counsel for Applicant :- Ghaus Beg Counsel for Opposite Party :- Namit Sharma Hon'ble Manish Kumar Nigam,J. Heard learned counsel for the parties. This contempt petition has been filed for violation of order dated 15.12.2023 passed by this Court in Writ Petition No. 9578 of 2023, wherein a direction was issued to the respondent No.5 to consider the case of the petitioner for regularization under Rules, 2016 afresh. Learned counsel appearing for respondents/opposite parties has submitted on the basis of compliance affidavit filed by the opposite parties that a decision has been taken by the Municipal Commissioner on 10.10.2024 and the said order has also been annexed along with the compliance affidavit. Learned counsel for the applicants submitted that the direction was given by the Court to the respondent No.5 i.e. the Committee to decide the same but the decision has been by the Municipal Commissioner which is only Chairman of the Committee and not by the Committee and therefore contempt has been committed. Since the claim of the applicants has already been rejected by the order dated 10.10.2024, therefore, no further orders are required to be passed in the present contempt petition and the petition is consigned to record. Notices, if any, are discharged. However, the applicants will have liberty to challenge the order dated 10.10.2024, in case they feel aggrieved by the said, in accordance with law.
