Also heard Mr. K K Parasar, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This application has been filed under Section 483 of the BNSS, 2023, whereby the petitioner Smt. Alemon Begum has prayed for releasing her on bail, after she was arrested in connection with Panbazar P.S. Case No. 138/2025. Page No.# 2/2 3. 74.58 grams of heroine was recovered from the possession of Rajib Ali. He told police that the present petitioner gave the said drug to Rajib Ali to sell in the market. Nothing was recovered from the possession of the petitioner. 4. Mr. Parasar has pointed out that the petitioner has given a statement before police that the petitioner has given drugs to Rajib Ali to sell in the market. 5. Mr. Munir has submitted that the petitioner has spent 56 days in judicial custody. Nothing was recovered from her possession. Only her statement made before police cannot be used against her for her custodial interrogation. 6. Therefore, the bail application of the petitioner is allowed. 7. It is hereby directed that the petitioner Smt. Alemon Begum, who was arrested in connection with Panbazar P.S. Case No. 138/2025, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of learned Special Judge, , Kamrup (Metro), Guwahati.
