Neutral Citation No. - 2025:AHC-LKO:23889-DB Court No. - 2 Case :- WRIT - C No. - 3915 of 2025 Petitioner :- Kapildev Verma And 19 Others Respondent :- State Of U.P. Thru. Addl. Chief Secy./Prin. Secy. Lok Nirman Vibhag U.P. Lko. And 6 Others Counsel for Petitioner :- Ram Raj Ojha,Anil Kumar Tiwari Counsel for Respondent :- C.S.C. Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J.
1. Shri Ram Raj Ojha, learned counsel for the petitioners and Shri Manish Mishra, learned Additional Chief Standing Counsel for the State.
2. The petitioners have filed this writ petition being aggrieved by the action of the opposite parties as alleged in compelling them to provide their land for public purpose without paying adequate consideration. Petitioners' counsel relies upon Annexure No. 2 which is a proposal to purchase certain land for the purpose of construction of a bypass.
3. This is not a case of compulsorily acquisition. It is case of proposed purchase of the said land in terms of the Government Order dated 19.03.2015. If the petitioners do not want to sell their land till they receive adequate
consideration there is no law which could compel them except a case where their land chould be compulsorily acquired. We have no reason to believe that the opposite parties can compel or would compel the petitioners to sell their land for inadequate consideration.
4. This order will not apply if the petitioners have already executed sale deed. In that eventuality they can raise their grievance as per law applicable.
5. The writ petition is disposed of accordingly. . (Om Prakash Shukla,J.) (Rajan Roy,J.)
