Learned counsel of the appellant places reliance on the order dated 13.07.2016 passed by the Division Bench of this Court in Special Appeal No. 1422 of 2011 (Harish Chandra vs. State of U.P. and Others) and submits that the controversy raised by means of present special appeal stands settled under the judgement and order of the Apex Court in State of U.P. vs. Dayanand Chakrawarty and Others being Civil Appeal No. 5527 of 2012 decided on 02.07.2013. 3. The Division Bench had also considered the judgement and order passed in Dayanand Chakrawarty (Supra) in Special Appeal No. 1422 of 2011 (Harish Chandra vs. State of U.P. and Others). Therefore, he submits that the instant appeal may also be disposed of in terms Harish Chandra (supra). 4.
