Panthi, learned Counsel appearing for the petitioner also Mrs. N. G. Shylla, learned PP assisted by Ms. I. Lyngwa, learned GA appearing for the State-respondents. By this application petitioner has sought for quashing of the proceeding of GR. Case No. 22(S) of 2019 pending before the Chief Judicial Magistrate , Shillong under Section 143 /145 /147/ 189/336 /353 / 427/435 IPC read with Section 6 MMPO Act & Section 3 PDPP Act. After arguing at some length, the learned Counsel for the petitioner fairly submits that since the Trial Court by order dated 21-08-2023 has 2025:MLHC:235 dropped some of the charges and decided to proceed only under the aforesaid sections of law, the petitioner would face the trial to prove his innocence as the ground raised in this petition concerns some of the factual aspects which may become clearer after evidence is recorded in the matter. He, therefore, prays that the instant matter may be disposed of with a direction to the learned Trial Court to proceed with the trail and dispose of the matter at the earliest. Mrs. N. G. Shylla, learned PP does not have any serious objection to the prayer made. However, she submits that no time frame can be fixed for disposal of the criminal trial. In consideration of the submissions made by the parties, this petition stands disposed of without making any observation as to the merits of the contention raised by the petitioner. It is expected that the learned Trail Court will proceed with the trail as expeditiously as possible.
