Neutral Citation No. - 2025:AHC-LKO:23328 Court No. - 18 Case :- WRIT - A No. - 4477 of 2025 Petitioner :- Gayatri Devi Respondent :- State Of Thru. Prin. Secy. Deptt. Of Home Rural And Dev. Lko. And 4 Others Counsel for Petitioner :- Manoj Kumar Yadav Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. 1. Heard learned counsel for the petitioner and learned Standing counsel for the respondent nos. 1 to 5. 2. By this petition, the petitioner has prayed for the following main relief:- "I. Issue a writ order or direction nature of mandamus thereby commanding to the opposite parties considered the qualification of the petitioner and prepared the merit list on the basis of all educational documents including graduation for appointment of Anganbadi karkatri in village Rehua Block and Tehsil Mahsi District Bahraich in the interest of justice. II. Issue a writ order or direction nature of mandamus thereby commanding to the opposite parties summon to the petitioner for verified the educational document and also appointed on the post of Anganbadi karkatri in village Rehua Mansoor Block and Tehsil Mahsi District Bahraich on the basis of merit list in the interest of justice." 3. Learned counsel for the petitioner submits that the petitioner is well educated lady and her merit is highest still she has not been called for the document verification. 4. Learned Standing counsel has produced the written instructions received by him by the authorities concerned before this Court. 5. Perused the record as well as the written instructions produced by the State counsel. Perusal of the written instructions shows that the petitioner applied online for Anganwadi Center Rehua Mansoorpur. The income certificate was verified on the e-district portal in which the petitioner's income certificate of Rs. 48000/- was issued on 27.12.2024. However, as per the Government Order dated 21.03.2023, the income certificate issued before six months from the date of issue of notification i.e. 18.12.2024 are admissible. According to Government Order the annual income limit for rural areas is Rs.46080/- and for urban area is Rs.56460/- to qualify under the BPL category. The annual income of the petitioner is Rs.48000/- which comes in the category of APL. Therefore, due to the availability of female candidates under BPL category for the said center, preference could not be extended to the petitioner. 6. In view of the above instructions, it is evident that the petitioner does not qualify as a Below Poverty line candidate and her income certificate was not issued within the validity period prescribed under the Government order dated 21.3.2023. Since the selection policy gives preference to BPL candidates and the petitioner does not fulfill the necessary eligibility, the petition lacks merit and is accordingly dismissed.
