Instant review application has been filed by Shri Ramu Verma and Shri Hemendra Mishra, learned counsels for the applicant praying for review of the judgment and order dated 05.04.2025 passed in Second Appeal No. 207 of 2024 in re: Yusuf Husain Vs. Shyam Lal. The Second Appeal has been decided after the list had been revised and none has appeared on behalf of the respondents even in the revised call despite the names of Shri Vinay Kumar Verma, Shri Raman Kumar and Shri Shashank Verma being shown from the side of respondent and neither was there any application or request for adjournment of the case. Instant review application has been filed on various grounds. Preliminary objection has been taken by Shri Adnan Ahmad, learned counsel for the opposite party-herein by contending that as per law laid down by Hon'ble Apex Court in the case of Tamil Nadu Electricity Board & Anr. Vs. N. Raju Reddiar & Anr. [(1997) 9 SCC 736], review application by a new counsel is not permissible. A perusal of the review application would indicate that none of the counsels who had appeared in the Second Appeal have filed the instant review application rather the review application has been filed by new counsels. Consequently, keeping in view the law laid down by Hon'ble Apex Court in the case of Tamil Nadu Electricity Board(Supra) and the review application being filed by a new counsel, the review application is rejected.
