Jyotsna Rewal Dua, Judge This writ petition has been filed for the grant of following substantive reliefs:- “a). That the respondents may kindly be directed to extend the benefit of counting of contract service followed by regular service for annual increments, pensionary benefits under CCS Rules (Pension) Rules 1972 and other consequential benefits to the petitioner. b) That the respondents may kindly be directed to extend the benefits of judgment dated 28.09.2023 (Annexure P- 3), passed in CWPOA No. 5343/2020 titled as Rajesh Bala Versus State of H.P. and others, & in CWPOA No.1746/2020 alogwith all consequential benefits; c) That the respondent No. 3 may kindly be directed to decide the representation dated 3.11.2024, Annexure P- 4, submitted by the Petitioner, within time bound manner;” 3. Though the respondents have filed reply to the writ petition, however, with the consent of learned counsel 1Whether reporters of Local Papers may be allowed to see the judgment? Yes -2- for the parties matter is heard and disposed of in the following manner. 4. Learned counsel for the petitioner submitted that the case of the petitioner and the reliefs prayed for by him has already been considered & adjudicated upon in Sanjay Kumar Versus State of Himachal Pradesh & others1. Learned counsel for the petitioner also submits that the representation dated 16.09.2023 (Annexure P-1) preferred by the petitioner, for claiming the above reliefs is pending consideration with the respondents. Learned counsel further submits that the petitioner would be content in case the respondents/competent authority is directed to decide the aforesaid representation within a fixed time schedule. Learned counsel appearing for the respondents is not averse to this prayer. 5. Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of with a direction to the respondents/competent authority to consider and decide the aforesaid representation of the petitioner in accordance with law as well as taking into 1CWPOA No.5536 of 2020, decided along with connected matters on 01.11.2023 -3- consideration the above judgment in the case of Sanjay Kumar1 within a period of six weeks from today. The decision so arrived at shall also be communicated to the petitioners. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
