“10.1 To pass suitable direction/writ to direct the respondent authorities to proceed for an enquiry over the erring officers where they had deliberately given wrong submissions specifically made by Resp.no.2 & 3 before this Hon'ble Court in WPCR no.319/2023, for sheltering the accused, relying upon which this Hon'ble Court had passed the order dated 31.07.2023 based on those wrong submissions. 10.2 To pass suitable direction/writ to direct the respondent authorities to is for a fair enquiry be concluded over the case registered at P.S Supela, Dist: Durg (C.G), FIR bearing crime no.198/2022 for the offence U/s 420, 467, 468, 471, 120-B of Indian Penal Code where misgiving of the fake loans have been disbursed against the vehicles by private respondents, where the concerned officers are influenced in a stature of giving false statement before this Hon'ble Court. 10.3 The, petitioner further prays that this Hon'ble Court may kindly be pleased to pass suitable direction/writ to direct the respondent authorities to proceed against the private respondents per law. 10.4 The, petitioner most respectfully prayed that this Hon'ble Court may kindly be pleased to pass suitable direction/writ to the enquiry be monitored by this Hon'ble Court. 3 10.5 Any other relief or reliefs that may be deemed fit and proper in the facts and circumstances of the case may kindly be granted also.”

At the outset, learned counsel for the State submits that as per the order of this Court dated 17/04/2025, Senior Superintendent of Police, District Durg, C.G. has filed his affidavit, which is on record, in which, it is stated that investigation in Crime No.198/2022 registered in the Police Station Supela, District:Durg has been concluded and the final report under Section 173(2) of Cr.P.C. [now under Section 193(3) of the BNSS] (Khatma) has already been submitted before the Chief Judicial Magistrate Durg on 09/05/2025 and the same has been marked as Annexure D/1. He further submits that since the investigation in the instant matter has been concluded and the police has submitted closure report before the competent Court, therefore, if the petitioner is aggrieved, he may take recourse of law. 3.
