Shashank Thakur, Advocate Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 25.03.2025 1) The petitioner has filed this petition seeking the following relief(s):-
“10.1 It is, kindly prayed that this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case. 10.2 The petitioners prays to this Hon'ble Court for issuance of suitable direction, writ, order directing the respondents to grant the benefits under the Rehabilitation Policy including grant of suitable compensation, employment to the members of the family, annuity and other benefits under the policy in lieu of the acquisition of their lands. -3- 10.3 That, the petitioner prays to this Hon'ble Court for issuance of appropriate writ, order, direction directing the respondents to restore / reverse the lands in favour of the petitioner Bhoomi Swami's. 10.4 That, this Hon'ble Court may kindly issue appropriate writ, order, direction for the initiation of appropriate departmental as well as criminal prosecution against the persons involved in the illegal land grabbing and mutation of the lands. 10.5 Any other relief/relief's, which this Hon'ble Court may think fit and proper in the facts and circumstances of the case with cost of the petition, may also please be granted to the petitioner.” 2) Mr. Sushobhit Singh, learned counsel for the petitioners would submit that lands bearing survey Nos. 160/1, 283, 372/1, 373, 467/2, 393/1, 374/1, 376, situated at village Bhadora were recorded in the names of Udho Singh and other joint owners. He would contend that a 350 Mega Watt Thermal Power Plant was proposed at village Bhadora. He would also contend that the revenue authorities and some other private persons manipulated the revenue records and part of the lands of the petitioners were sold through registered sale deed to private respondents. He would submit that an enquiry was conducted and accused persons were prosecuted.
He would further submit that a direction may be issued to the respondent authorities to enter names of the petitioners in the revenue records and to make payment of compensation along with other ancillary benefits. 3) On the other hand, Mr. Prateek Tiwari, learned Panel Lawyer appearing for the State would submit that the petitioners never approached the revenue
-4- authorities for correction of land records. He would further submit that in enquiry it was found that 19 forged sale deeds were executed. He would also submit that if the petitioners will make representation(s) before the respondent No.2 along with relevant documents, appropriate decision would be taken. 4) Taking into consideration the dispute involved in the present case, this writ petition, at this juncture, is disposed of reserving liberty in favour of the petitioner to make a detailed representation along with relevant documents before the respondent No.2 within a period of 30 days, and in turn, the authority concerned is directed to examine the matter of the petitioners and take appropriate decision within a period of 120 days. 5) With the aforesaid observation(s) and direction(s), the instant writ petition is hereby disposed of.
