Heard Sri Syed Anzar Husain, learned counsel for the petitioner and Sri Nitin Mathur, learned Addl. C.S.C. for the opposite parties. By means of this petition the petitioner has prayed following relief : "Issue a writ order or direction in the nature of mandamus commanding and directing the opposite party no. 2 to decide the representations of the petitioners and do proper fixation of pay as per their cadre and post and other benefits accordingly and pay to petitioners accordingly." Learned counsel for the petitioner has stated that the grievance of the petitioner may be redressed in the light of the judgment of this Court in re: Uma Shankar Singh and others etc. vs. State of U.P. & others : 2002 All. L.J. 1800. He has further submitted that the petitioner has preferred representation but no decision has been taken by the concerning authority i.e. opposite party no. 4. Therefore, he has requested that liberty may be given to file a fresh representation. With the consent of parties the writ petition is disposed of finally at the admission stage. Without entering into the merits of the issue, the petitioner is permitted to move a fresh representation within 15 days before the opposite party no. 4 i.e. Director, Secondary Education, Camp Office, Park Road, Lucknow taking all his pleas and grounds and enclosing his earlier representations along with all relevant documents. If such a representation is moved the opposite party concerned is directed to dispose of the representation of the petitioner with speaking and reasoned order after affording an opportunity of hearing to the parties concerned, strictly in accordance with law expeditiously and also in the light of the aforesaid judgment after verifying the applicability of the aforesaid judgment in the present case, say within a period of ten weeks from the date of production of the certified copy of this order. The decision on the representation shall be communicated to the petitioner forthwith. Writ petition is finally disposed of. .
