The instant application has been filed by the petitioners for modification in the last portion of the order dated 13.10.2023 in B.A. No.8703 of 2023 whereby the petitioners were directed to appear on each and every date before the learned trial court. 2. Learned counsel for the petitioners submits that the age of the petitioners is above 90 years; as such, they may be released from this direction and the trial court may be directed to exempt them from appearance on each and every date. 3. Learned A.P.P. does not have any serious objection. 4. Having regard to the aforesaid facts and circumstances of the case, the last paragraph of the order dated 13.10.2023 passed in B.A. No.8703 of 2023 is modified to the extent that the 2025:JHHC:18954 2 petitioners shall appear as and when directed by the learned trial court and on rest of the dates their counsel shall file a proper application as to the reason that the petitioners are not able to appear on that particular date. 5.
