Neutral Citation No. - 2025:AHC-LKO:23558 Court No. - 3 Case :- WRIT - A No. - 4395 of 2025 Petitioner :- C/M Janak Laghu Madhyamik Vidyalaya Thru. Its Manager Janakdev Rai Respondent :- State Of U.P. Thru. Its Addl. Chief Secy. Basic Education And 5 Others Counsel for Petitioner :- Lalendra Pratap Singh Counsel for Respondent :- C.S.C. Hon'ble Rajesh Singh Chauhan,J.
1. Heard Sri Lalendra Pratap Singh, learned counsel for the petitioner and Sri Sanjeev Singh, learned Standing Counsel for opposite parties No. 1 to 4.
2. It has been informed by one Advocate, namely, Vikalp Kumar Rai, who is not representing any opposite parties here, that the same petitioner has filed one writ petition bearing Civil Misc. Writ Petition No.19197 of 2023 before this Court at Allahabad making prayer that the competent authority be
directed to release the salary of teaching and non-teaching staff of the institution in question. Sri Rai has informed that in the petition pending before this Court at Allahabad, the necessary parties to whom he is representing, have not been impleaded therefore, he file an impleadment application before this Court at Allahabad, wherein his clients, namely, Anil Kumar Rai and Om Prakash Mishra have been impleaded. He has also submitted that the alleged innocuous prayer that the representation of the petitioner be decided by the Principal Secretary of the department is not so innocuous inasmuch as this relief may be prayed by the petitioner before this Court at Allahabad in his pending writ petition. Sri Rai has also informed that this fact has not been disclosed in this writ
petition. Virtually, the prayer of the petitioner is one and the same inasmuch as in this writ petition, the petitioner has prayed that the opposite parties may be directed to decide the representation of the petitioner with respect to release of salary of the employees of the petitioner institution.
3. Having considered the submission of Sri Vikalp Kumar Rai and the documents so shown by him i.e. impleadment application filed before this Court at Allahabad, I hereby dismiss this writ petition in limini, however, it is always open for the petitioner to file an appropriate application before the Civil Misc. Writ Petition No. 19197 of 2023 (supra).
4. Dismissed.
