Heard the parties. The petitioner has been made accused in connection with NDPS P.S. Case No.33 of 2025 arising out of Arki P.S. Case No. 10 of 2025 registered for the offences punishable under section 18(b) of the Narcotics Drugs & Psychotropic Substance Act, 1985.. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cultivation of opium. It is further submitted that the allegations against the petitioner are all false and the petitioner has no concern either with the alleged field or the alleged opium. It is then submitted that the petitioner has no criminal antecedent as has been mentioned in para -18 of the bail application. It is next submitted that the petitioner has been in custody since 08.02.2025, as has been mentioned in paragraph no. 19 of the bail application. It is further submitted that the petitioner undertakes to cooperate with the trial of the case. It is next submitted that the co-accused with similar allegations have already been admitted on bail by this court vide order dated 11.06.2025 passed in BA No. 3983
of 2025, hence, it is submitted that the petitioner be admitted to bail. Learned Spl.. P.P. opposed the prayer for regular bail . Considering submissions of learned counsels and the facts as stated above, I am inclined to release the petitioner on bail. Hence, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.
25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS, Khunti, in connection with NDPS P.S. Case No.33 of 2025 arising out of Arki P.S. Case No. 10 of 2025 with the condition that the petitioner will co-operate with the trial of the case and will furnish mobile phone number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change the mobile phone number during the trial of the case.
