Limited prayer addressed in this writ petition is for declaring action of respondent No.3 in issuing auction notice dated 25.09.2025 under Rule VIII of the Security Interest (Enforcement), Rules, 2002, without issuing a fresh notice under Section 13(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (in short
“SARFAESI Act”) to be illegal, arbitrary and violative of principles of natural justice. Petitioner seeks setting aside of auction notice dated 25.09.2025.

Learned counsel for respondents submits that pursuant to issuance of auction notice as there were no bidders, the same did not fructify, present writ petition is rendered infructuous as such.

Learned counsel for petitioner is unable to deny the same. However, it is submitted that liberty be afforded to petitioner to avail the remedies available to him, in accordance with law in respect to any other grievance arising in respect to the proceedings under SARFAESI Act initiated by respondent-Bank.
4. Keeping in view facts and circumstances as above, proceedings are closed, with liberty to petitioner as aforesaid.
No order as to cost. Pending application(s), if any, stand(s) disposed of accordingly.
