The petitioner is the successful bidder pursuant to the tenders floated by the second respondent Corporation on 23.02.2024 and 08.03.2024. It appears that the petitioner had earlier approached this court in W.P(MD)No. 21579 of 2024 which came to be disposed of on 11.09.2024, whereby, the encroachers outside the marketing complex were directed to be removed. 3. Since the said order was not complied by the respondents by removing the encroachment, the petitioner filed a contempt petition in Cont.P(MD)No.122 of 2025. On 29.01.2025, a letter was issued by the third respondent, whereby, it was informed that the encroachments will be removed. The contempt petition was closed in the light of the aforesaid communication, the content of which has been extracted above. 5. The present writ petition has been filed to implement the aforesaid undertaking given by the respondent and to remove the shops put by the respondents 5 and 6, who have not participated in the tenders floated on 23.02.2024 and 08.03.2024. 6. The learned counsel for the sixth respondent submits that the private respondent is a license holder, as required under Section 108(1) read with Section 4 of the Tamil Nadu Urban Local Bodies Act, 1988. The only complaint against the sixth respondent is that the sixth respondent has purchased vegetables from the fifth respondent who is not authorised. 7. I have considered the arguments advanced by the learned counsel for the petitioner, learned Special Government Pleader for the first respondent, learned Standing counsel for the respondents 2 to 4 and the learned counsel 5/8 https://www.mhc.tn.gov.in/judis W.P(MD)No.12087 of 2025 for the sixth respondent. 8. The respondents are bound to comply with the contents of the communication dated 29.01.2025, which was filed before this Court in Cont.P(MD)No.122 of 2025, which came to be disposed of on 29.01.2025 based on the undertaking given by the third respondent. 9. Accordingly, the official respondents are directed to examine whether the private respondents have violated Section 108 of the Tamil Nadu Urban or not and to take appropriate action. It is needless to state that before passing such order, notice shall be issued to the private respondents also. The entire exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order. 10. The writ petition stands disposed of. No costs.
