According to the petitioner’s Counsel, the said demand as raised by the opposite party no. 6 vide notice dated 17.12.2022 contained as Annexure No. 6, was not payable under the G.S.T. Act, 2017. It is also his submission that during pendency of the writ petition, an advance ruling was sought under Section 98(4) of both the G.S.T. Acts, the Central and the State, and the advance ruling is in favour of the petitioner, therefore, the impugned notice is liable to be quashed, especially in view of the admitted legal position, as averred in the Paragraph 5 of the counter affidavit of the opposite party no. 6. However, Shri Neerav Chitravanshi, learned Counsel appearing for the opposite party no. 5 says that Purvanchal Vidyut Vitaran Nigam Limited has obtained an advance ruling under Section 98(4) of the G.S.T. If it is so, then the consequences would follow accordingly as per law, in view of the statement made by Shri Neerav Chitravanshi, learned Counsel for the opposite party no. 5. Opposite parties no. 5 & 6 to act accordingly, and if the impugned demand notice is liable to be withdrawn, then the same will be withdrawn within three weeks, and the withdrawal be communicated to the petitioner.
