Neutral Citation No. - 2025:AHC-LKO:22842-DB Court No. - 2 Case :- WRIT - C No. - 3823 of 2025 Petitioner :- Pradeep Sharma And Others Respondent :- Canara Bank, New Hyderabad Lucknow Thru. Branch Manager, Lko. Counsel for Petitioner :- Saurabh Tiwari,Ravindra Kumar Singh Counsel for Respondent :- Vinay Shankar Hon'ble Rajan Roy,J. Hon'ble Om Prakash Shukla,J.
1. Heard.
2. The petitioner Nos.1, 2 and 3, who are husband, daughter and son, respectively, want release of the amount deposited in the account which was jointly held by their wife/mother and mother-in-law/grandmother with the opposite party-Bank. The mother-in-law/grandmother had died and wife/mother of the petitioners is in coma. Bank's Counsel says that in these circumstances, there is no procedure for release of the amount in favour of the petitioners, especially as, they are not even a nominee in the account. The only option available to the petitioners is to seek a succession certificate from the competent Court.
3. In view of the aforesaid, as learned Counsel for the petitioners has not been able to place before the Court any law under which the relief prayed could be granted, we have no other option but to dispose of this petition with liberty to the petitioners to get a succession certificate from a Court of competent jurisdiction and then approach the opposite party- Bank.
4. With the aforesaid observations, the writ petition is disposed of. (Om Prakash Shukla, J.) (Rajan Roy, J.) Order Date :- 22.4.2025 -Piyush- Digitally signed by :- PIYUSH YADAV High Court of Judicature at Allahabad, Lucknow Bench
