Learned counsel for the petitioner has submitted that the
order passed by the Tribunal is not only illegal, but arbitrary as the same is passed without any jurisdiction. It is further submitted that by the impugned transfer order, the respondent-department has re-located the petitioner-employee from higher post to a lower post, which is per se in-violation of the settled position of law. 3. In support of the contentions made insofar, learned counsel has placed reliance upon the ratio passed in S.B. Civil Writ Petition No.10796/2022 titled as Hira Lal Tabiyar Vs. State of Rajasthan & Ors. 4. Heard and perused the material available on record. 5. From perusal of the impugned transfer order, it is noticed that the petitioner is working on the post of Principal Chief Medical Officer and while passing the said transfer order, the respondents have considered the public interest, administrative exigencies, the fact that the medical services falls under the ambit of public utility services and the history of posting of the petitioner employee. It is also noted that on erstwhile three occasions, the petitioner has approached legal forums and interim protection was granted. Nevertheless, the learned Tribunal has considered the entire aspects of the matter in hand; for the sake of handiness and reference the relevant extract from the said order is reproduced herein below:
