Upon coming of the instant contempt petition for consideration, the counsel for the respondents referred to the compliance report filed on 07.03.2025 to the contempt petition and would contend that the petitioner though was initially appointed as a Cleaner in the Corporation, but subsequently was promoted as a Driver in the year 1998 along with the grade attached to the post of Driver being 1200-2140 drawn by the petitioner w.e.f. 01.01.1996 in terms of order dated 19.01.1998, as by then, the said grade has been revised to that of Rs. 4000-110-6090 and that the petitioner was even drawing the said grade continuously uptill his superannuation on 31.10.2010, whereafter the petitioner came to be paid cash in lieu of leave salary in terms of SRO-124 of 1998 to the tune of Rs. 90,420/-, as also gratuity in terms of order dated 31.01.2011 and that the petitioner had also been granted all consequential benefits w.e.f. 22.10.1998, when the petitioner was placed in the said grade in the year 1998 upon revision thereof and, therefore, in essence, the judgment and order dated 20.02.2009, non-compliance of which S. No. 14 CPSW No. 9/2012 in SWP No. 1412/2005 has been alleged to have had been implemented prior to the passing of the same qua the retrospective claim of release grade by the petitioner. 2. Confronted with the aforesaid stand taken by the respondents, the counsel for the petitioner could not deny or dispute the same, while stating that the stand taken by the respondents, seemingly, is based on records. 3. Having regard to the aforesaid position obtaining in the matter, no further proceedings need to be conducted in the instant contempt petition. Accordingly, contempt proceedings are closed.
