Heard learned counsel for the petitioner, Sri Rajendra Prasad Yadav, learned counsel appearing on behalf of the respondent no. 6 and perused the record. 2. The present petition has been filed by the petitioner with the following prayer :- "(i). Issue a writ, order or direction in the nature of Mandamus commanding and directing the Opposite Party No. 2 to 5 to remove / demolish the illegal encroachment from the illegal possession of Opposite Party No. 6 to 8, over the Land Gata No. 823, area 0.1580 Hect., situated in Village-Birahimpur Belahaura (Hisampur), Tehsil Kaisarganj, District- Bahraich, which is recorded as Rasta in the revenue records, by following the verdict of the Hon'ble Supreme Court in the case of Hinchlal Tewari Vs Kamla Devi (2001) 6 SCC 496." 3. Learned Standing counsel based upon the instructions states that the proceedings under Section 67 of the U.P. Revenue Code, 2006 have been initiated in view of the subsequent encroachment, which are pending. 4. In view of the said statement, the present petition is disposed of with direction to conclude the proceedings which are pending, expeditiously in accordance with law after hearing the effected parties, preferably within a period of 90 days.
