Heard learned counsel for the parties and perused the record. 2. The instant petition has been filed for the following relief: "i) to issue a writ, order or direction in the nature of mandamus directing the court of learned Additional District Magistrate, Finance and Revenue, District-Azamgarh to decide the Case No. D202315060002910 of 2023 (Rafeek Vs. Sushma and others) under Section 128 of U.P. Revenue Code-2006 for cancelling lease dated 15.02.2007 regarding the arazi No.338MI area 0.0280 and 339 area 0.0110 hect., situated at Palia Mafi, Pargana-Mahul, Tehsil-Phoolpur, District-Azamgarh pending before the Additional District Magistrate, Finance and Revenue, District-Azamgarh expeditiously, within a specific period as fixed by this Hon'ble Court." 3. Since, the matter is pending before the trial court and this court does not know the actual pendency of the cases before the court below, therefore, no direction can be given to decide the matter in a time frame. 4. As the matter is pending, it is expected that it should be decided by a reasoned and speaking order, in accordance with law, after affording opportunity of hearing to the parties concerned without granting unnecessary adjournments to either of the parties. 5.
