Neutral Citation No. - 2025:AHC-LKO:26759 Court No. - 3 Case :- WRIT - A No. - 4543 of 2025 Petitioner :- Arpit Katiyar Respondent :- Distt. Magistrate Distt. Behraich And 3 Others Counsel for Petitioner :- Shailendra Kumar Counsel for Respondent :- C.S.C. Hon'ble Rajesh Singh Chauhan,J. 1. Case called out. Learned counsel for the petitioner is reported to be out of station. 2. It has been informed by Sri Raghvendra Pratap Singh, learned Addl. Chief Standing Counsel that this is the fifth time, this case has been listed but learned counsel for the petitioner is seeking adjournment for one reason or another. 3. Sri Raghvendra Pratap Singh has further submitted that by means of this petition, the petitioner has assailed the orders dated 29.12.2023 and 10.01.2024 (Annexures No.1 & 2) whereby engagement of the petitioner has been cancelled. The petitioner is an outsourced employee discharging the job of Career Counsellor/ MIS Manager, U.P. Skill Development Mission, District- Bahraich. Annexure No.2 of the writ petition is notice dated 10.01.2024 given to the petitioner by the service provider agency i.e. AB Enterprises and pursuant to the aforesaid notice, the petitioner has been disengaged. No appointment order has been issued by the State Authority or instrumentality thereof, rather a letter of deployment was issued by one Lotus Construction on 01.07.2020, therefore, Sri Raghvendra Pratap Singh has stated that since the petitioner cannot get any relief by filing writ petition under Article 226 of the Constitution of India inasmuch as he is an outsourced employee and has got no direct nexus with the State Authorities or instrumentality thereof, so learned counsel for the petitioner did not appear to argue the case on any of the earlier dates. 4. Having considered the submission of Sri Raghvendra Pratap Singh, learned Addl. Chief Standing Counsel and perusing the material available on record, I find substance in the submission of learned Addl. Chief Standing Counsel, therefore, this writ petition is dismissed being misconceived. 5. However, it is needless to say that the petitioner may approach his service provider/ outsourced agency or any competent authority for redressal of his grievance but strictly in accordance with law.
