Heard learned counsel for the parties and perused the record. 2. This petition has been filed for the following relief: "I. to issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 26.12.2024 passed by respondent no.02. II. to issue a writ, order or direction in the nature of mandamus directing the respondent authorities to accord the approval in favour of the petitioner in respect of Plot No.156 (1.0120 hect.) & 157 (0.2400 hect.) situated at village-Panchayat Ramapur Nayay Panchayat-Rampur, Taluka-Majhwan, Pargana-Kasiwar, Tehsil- Sadar, District-Mirzapur in pursuance of Auction dated 13.09.2024 and to permit the petitioner cultivate his fishes during pendency petition." 3. Contention of the learned counsel for the petitioner is that the petitioner is the highest bidder and before the patta could be approved in favour of the highest bidder, an objection was filed and the entire auction proceedings were cancelled and it has been directed that fresh auction will be held. 4. Neither the patta of the petitioner has been approved nor any agreement has been entered into between the petitioner and respondents. No rights, legally enforseable has been created in favour of the petitioner and therefore, I am not inclined to interfere in the matter. 5. However, it is provided that since fresh auction is to be held, liberty is granted to the petitioner to participate in the fresh auction and the respondents are directed to permit the petitioner to participate in the auction proceedings without being influenced any of the findings recorded in the order impugned. 6.
