Present applicant- Surendra Mehto is praying for regular bail in relation to FIR dated 12.03.2003 registered as FIR No. 259 of 2003 at P.S. Kiccha District Udham Singh Nagar wherein the present applicant has been charge sheeted for the offence punishable under Sections 363, 366 and 376 IPC. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated. Apart from this, after completion of investigation charge sheet has already been filed and the trial has been commenced. He further submits since charge sheet has already been filed therefore there is no need of custodial interrogation of the present applicant. Apart from this he submits that the applicant is languishing in jail since 22.09.2024 and he has no previous criminal history. 5. On the other side, learned State counsel has not disputed this fact that the charge sheet has already been filed and the trial has been commenced and the applicant has no previous criminal history. 6. After hearing the arguments of the learned counsel for the parties, and further taking into consideration that charge sheet has already been filed and 2025:UHC:2697 there is no need of custodial interrogation of the applicant, this Court is of the view that the applicant deserves for bail. 7. Accordingly, the bail application is allowed. 8. Let the applicant Surendra Mehto be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
