The present application has been filed for the following main relief:- For the facts, reasons and circumstances mentioned in the accompanying affidavit it is most respectfully prayed that this Hon'ble Court may kindly be pleased to set aside the impugned summonsing order dated 4.11.2022 issued by the learned Judicial Magistrate Purwa Unnao, in Criminal Misc. Case No. 535/2022 (Aradhana Devi versus Rakesh Kumar & others) under sections 498A, 323, 504, 506 I.P.C. & 3/4 Dowry Prohibition Act pertaining to Police Station Purwa District Unnao pending in the court of Judicial Magistrate Purwa Unnao during the pendency of the instant petition to secure the ends of justice. as well as impugned revisional order dated 28.11.2023 passed by the learned Additional Sessions Judge /Special Judge E.C. Act Court No.4w Unnao thereby rejecting the Criminal Revision No. 146 of 2022 (Rajendra Kumar & other versus Aradhana & another)including impugned Complaint Case No.535/2022 (Aradhan Devi versus Rakesh Kumar & ithers) to secure the ends of justice. (Annexure No.4&6). Sri Alok Kumar Srivastav, learned Counsel for the applicants says that matrimonial dispute between opposite party no.2 and Rakesh Kumar s/o Shiv Mangal has been settled and therefore, the present application filed by Rajendra Kumar, Madhuri Devi and Shubham, who are brother-in-law (Jeth), Sister-in-law (Jethani) and nephew (Bhatija) of the informant/opposite party No. 2, may be dismissed as withdrawn. To the aforesaid prayer, learned A.G.A. has no objection. Accordingly, the present application is dismissed as withdrawn.
