10.03.2025 24. Ct No. 28 SG [Rejected] C. R. M. (A) 826 of 2025 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with G.R. Case No. 04/2025 arising out of Asansol Cyber Crime Police Station Case No. 04 of 2025 dated 07.01.2025 under Sections 303/316(2)/318(4)/319(2)/338/336(3)/340(2)/61(2) of BNS. And In Re: Bikash Nonia @ Vikash Nunia @ Vicku. … … Petitioner Sk. Salim. … for the petitioner Mr. Bibhaswan Bhattacharya, Mr. Abhinaba Mukherjee. …. for the State 1. Petitioner submits he is no way connected with the alleged racket. He was not present at the spot when police raided the spot and arrested others. Accordingly, he prays for anticipatory bail. 2. Learned Advocate for the State opposes the prayer for anticipatory bail. 3. We have considered the materials on record. Petitioner is one of the prime conspirators in a cyber fraud. Modus operandi of the gang was to steal mobile phones from individuals and utilize them for committing cyber fraud. Thereafter, the stolen money was kept in mule accounts arranged by the petitioner and siphoned away. Custodial interrogation of the petitioner is necessary to unravel the ramifications of the crime and recover the proceeds of crime. 2 4. Under such circumstances, we are not inclined to grant anticipatory bail to the petitioner. 5. Application for anticipatory bail is, thus, rejected. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
