Borthakur, learned counsel for the petitioners and Mr. D. Saikia, learned Advocate General, Assam assisted by Mr. D. Nath, learned Senior Government Advocate, Assam for the respondents. 2. The basic grievance raised in this writ petition is that the provision of Rule 73 of the Assam Motor Vehicle Rules, 2003, has not been followed while issuing the impugned Notice annexed to this petition as Annexure-12. 3. In the backdrop of the aforesaid allegation, this Court had requested Mr. Nath, learned Senior Government Advocate, Assam to produce the record relatable to the decision in question to verify whether the procedure has been followed or not. Accordingly, Mr. Nath, learned Senior Government Advocate, Assam has produced the same before the Court. 4. Mr. Borthakur, learned counsel for the petitioners has also gone through the record and in his usual fairness, he has submitted that substantially the aforesaid Rule has been followed and accordingly, this writ petition may be closed with a liberty to the petitioners to assail the decision itself, based on which the Annexure-12 was issued, if so advised. 5.
