Heard the learned counsel for the petitioner and the learned 2. / Assistant Public Prosecutor. 3. The Inspector of Police, SN Puram Police Station, Vijayawada ^ submitted a report stating that pursuant to the Revision filed by the petitioner, police conduced investigation and filed charge sheet deleting the names of Respondent Nos.1 to 3. The charge sheet was numbered as C.C.No.1103 of 2005. The trial was conducted by the learned Magistrate and the ended in acquittal’ as Accused Nos.1 to 4 were found not guilty for the offences under Sections 420, 468, 471 and 419 r/w.34 of IPC. The assigned by the learned I Addl. Chief Metropolitan Magistrate Vijayawada while dismissing the protest petition was that the petition was premature as the petitioner has got sufficient cause to file an application under Section 319 of Cr.P.C during the trial if any incriminating material was forthcoming against the present unofficial respondents herein. Be that as it may, as the C.C itself was ended in “acquittal” by the learned Magistrate before whom the protest petition was filed and dismissed, nothing remains in this Criminal Revision Case for adjudication further on the order passed by the learned Magistrate dismissing the protest petition. Accordingly, the Criminal Revision Case is dismissed as infructuous. There shall be no order as to costs.
